Cannabis Clubs in Mallorca Explained
Cannabis social clubs are one of the most misunderstood things about Spain. Visitors to Mallorca hear the words "cannabis club" and picture a Dutch-style coffeeshop. That is not what they are, and the difference matters.
What a cannabis social club is supposed to be
A cannabis social club is a private, non-profit association of adult members who collectively grow a limited amount of cannabis for their own personal use. The legal theory is that this is shared private consumption rather than trafficking, because nothing is sold to the general public.
The model grew up in Catalonia and the Basque Country and spread across Spain. It has never been written into national law as a legal business model; it exists in a space courts have repeatedly narrowed.
Why the legal ground is unstable
The Spanish Supreme Court has ruled against several clubs, treating organised large-scale supply as trafficking even when it is dressed up as an association. The Constitutional Court has also struck down regional attempts to regulate clubs, on the basis that criminal law is a national matter.
The practical result is that clubs open, get raided, close and reopen. A club that was operating last season may not exist this season.
How membership is meant to work
In the intended model you must be over 18, be invited or referred by an existing member, sign up in person, and wait a period before you may collect anything. Membership is annual and personal, and the association is supposed to serve local consumers, not visitors.
A club that signs up a tourist at the door, takes cash immediately and hands over cannabis on the spot is not following that model, whatever the sign outside says.
What tourists in Mallorca actually run into
In Palma and the big resorts, most people who go looking for a club find either nothing at all or a street promoter offering to "sign them up". Following a stranger to an address, paying a joining fee in cash and being handed a product of unknown origin is how holiday scams and worse situations start.
Nothing about walking out of such a place with cannabis in your pocket is protected: once you are on the street, the public-possession rules apply to you like anybody else.
