Spain vs Mallorca: How the Cannabis Rules Differ
People often ask whether Mallorca has "its own rules" for cannabis. The law itself is the same across Spain. What differs is how, where and how often it is enforced, and the Balearic Islands have added their own layer on top of it.
The law is national
Criminal law in Spain is set nationally, so an autonomous community such as the Balearic Islands cannot legalise cannabis or create its own licensing system. The Constitutional Court has confirmed this by annulling regional cannabis club rules elsewhere in the country.
That means the basic picture in Palma is identical to the picture in Madrid or Barcelona: trafficking is criminal, public use and possession are administrative offences, private use at home is not prosecuted.
What the Balearics add locally
Local governments control public order in the street, and Calvià , Palma and Llucmajor have all used that power in the tourist zones. The so-called tourism of excess decree has targeted Magaluf, El Arenal and parts of Playa de Palma with restrictions on street drinking, party boats and organised pub crawls, backed by large fines.
Those rules are aimed at alcohol and street behaviour rather than cannabis specifically, but they come with far more police on foot in exactly the areas where visitors are most likely to be careless.
Enforcement is a local decision
A quiet village in the Tramuntana, the promenade in Palma and the strip in Magaluf on a August night are three different worlds in terms of police presence. Nothing in the written law changes between them; the odds of being stopped change enormously.
Officers also have discretion in how they handle a small personal amount. A cooperative adult with a couple of grams in a hotel district is a different conversation from someone smoking openly in front of a family beach.
Ferries and flights between the islands
Travelling from Mallorca to Ibiza or Menorca is a domestic journey, but it still involves security checks, and carrying a controlled substance through them is not a risk worth taking. Airport security passes anything it finds to the Guardia Civil.
